Music Licensing Terms and Conditions

 

By enrolling in the OHI Music License Program you acknowledge:

 

  1. To qualify for  OHI’s discounted rates and purchase a music license through  OHI, an outdoor hospitality business must maintain an active membership with OHI (and state association, if applicable) for the duration of the licensing period.
  2. An outdoor hospitality business must also be in good standing with the licensing performing rights organization (PRO) throughout the tenure of the licensing period and hold a license in each subsequent year of operation. Failure of such good standing will result in invalidated license(s) and no refund.
  3. Any lapsed licenses must be paid in full prior to the purchase of a new license.
  4. If an outdoor hospitality business currently holds a direct licensing contract with a PRO (ASCAP, BMI, SESAC or GMR), the direct contract must be canceled in writing and sent directly to the appropriate PRO.
  5. Additional licensing fees may apply for events for which a hard ticket from an outside source is required for admission, any event which requires a separate admission fee of $25 or higher, or if your park incurs annual live entertainment expenses in excess of $5,000. If your park incurs such expenses for live entertainment, you are required to self-report and this will increase the cost of your annual license. If you incur expenses in excess of $5,000 for live entertainment, you are required to notify OHI and OHI will provide your business with more information on additional licensing requirements.
  6. Pricing subject to change based on contractual requirements with the performing rights organizations (PROs).
  7. Licensing fees are subject to change based on the outdoor hospitality business’ actual rentable site count.
  8. No payments will be received outside of the open enrollment period. All payments for 2024 music licenses through the OHI discounted music license program must be received by Dec 20, 2023. If you miss this deadline, you must secure your 2024 music licenses directly through the performing rights organizations (PROs) at their published rates.
  9. All music licensing sales through OHI’s Music Licensing Program are final. Refunds are not given after purchase.
  10. Active music licenses are transferable only if ownership of the covered outdoor hospitality business changes during a covered calendar year.
